These Terms of Service (“Terms”) govern your use of fasttractraction.com and any content, features, and services offered on it (together, the “Site”), and your purchase of products from Fast-Trac Industries Inc. (“Fast-Trac,” “we,” “us,” or “our”).
Please read these Terms carefully. By visiting the Site or placing an order, you agree to be bound by them, including the safety and installation terms in Section 6, the limitation of liability in Section 12, and the dispute resolution terms in Section 15. If you do not agree, do not use the Site.
Our Privacy Policy, Refund Policy, and Shipping Policy are incorporated into these Terms by reference.
1. Eligibility and accounts
You must be at least the age of majority in your state or province of residence to purchase from the Site, or have the consent of a parent or guardian who agrees to these Terms on your behalf. You may not use the Site for any unlawful purpose or in any jurisdiction where doing so would violate local law.
If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Tell us promptly at info@fasttractraction.com if you believe your account has been compromised. We may refuse service, close accounts, cancel orders, or limit quantities at our discretion.
2. Products, fitment, and descriptions
We make every effort to display our products, specifications, and colors accurately, but we cannot guarantee that your display renders colors accurately or that every specification is free of error.
Fitment is your responsibility to confirm. Our traction products are sized to your specific setup. Stud length, quantity, and pattern depend on your track's lug height, track type, tunnel and heat-exchanger clearance, and how you ride. Any fitment tool, recommendation engine, size chart, or suggestion on the Site — including results produced by our product recommender pages — is a guideline based on the information you provide. It is not a warranty of fit or performance. You are responsible for verifying that the product you order is correct for your machine before installing it.
If you are unsure, contact us before you order. If you receive a size that does not fit your setup, see our Refund Policy for exchange terms.
3. Pricing, orders, and errors
Prices are in U.S. dollars and are subject to change without notice. Product availability is not guaranteed, and we may limit or cancel quantities purchased per person, per household, or per order — including orders placed under the same account, the same payment method, or the same billing or shipping address.
Occasionally information on the Site contains a typographical error, inaccuracy, or omission relating to price, description, promotion, shipping charge, transit time, or availability. We reserve the right to correct any error and to cancel or refuse any order placed at an incorrect price, including after the order has been submitted and your payment method charged. If we cancel your order for this reason, we will refund you in full and notify you at the email address you provided.
Your receipt of an order confirmation email does not signify our acceptance of your order — it confirms that we received it. We may accept or decline any order.
4. Billing and payment
You agree to provide current, complete, and accurate purchase and account information, and to promptly update it so we can complete your transaction and contact you. You represent that you are authorized to use the payment method you provide.
Sales tax is applied where required. You are responsible for any duties, taxes, or customs fees on international shipments. Financing offered at checkout through a third-party provider is a separate agreement between you and that provider and is subject to its terms and approval.
5. Dealer and wholesale accounts
If we approve you for a dealer, wholesale, or B2B account, additional terms apply: tiered pricing is available only to the approved account and may not be transferred; you must supply a valid resale certificate where required; products purchased at wholesale are for resale in the ordinary course of your business, and we may set conditions on resale channels. We may modify or revoke dealer pricing and terms at any time on notice to you. Where dealer terms conflict with these Terms, the dealer terms control for that account.
6. Safety, installation, and assumption of risk
This section is important. Snowmobile traction products affect how your machine handles and stops.
- Installation. Our products must be installed correctly, in the correct pattern, with the correct backing plates and torque, on a track in serviceable condition. Improper installation — including studs that are too long for your lug height, incorrect spacing, over- or under-torqued fasteners, or installation on a worn or damaged track — can damage your track, tunnel, heat exchanger, or suspension, and can cause loss of control.
- Clearance. You are responsible for confirming adequate clearance between the installed product and every part of your machine, and for re-checking clearance after any suspension or track change.
- Inspection. Traction products are wear items. You are responsible for inspecting them before each ride and replacing worn, bent, loose, or missing components.
- Riding conditions. Studded tracks change braking, cornering, and acceleration behavior, and may be restricted or prohibited on certain trails, lakes, roads, groomed surfaces, and by certain clubs, landowners, and jurisdictions. You are responsible for knowing and following the rules that apply where you ride.
- Assumption of risk. Snowmobiling is an inherently dangerous activity. By purchasing and using our products, you knowingly and voluntarily assume all risk of injury, death, and property damage arising from their installation and use, and from your operation of a snowmobile.
Follow the installation instructions supplied with your product and your snowmobile manufacturer's guidance. If you are not confident installing the product yourself, have it installed by a qualified professional.
7. Warranty
Our products are warranted as described in the warranty terms published on the Site and supplied with your product. Any warranty covers defects in materials and workmanship. It does not cover normal wear, improper installation, incorrect sizing, use on a worn or damaged track, racing or competition use, modification of the product, corrosion from environmental exposure, or damage resulting from any of these.
To make a warranty claim, contact us at info@fasttractraction.com with your order number and photographs of the issue. Warranty coverage extends to the original purchaser and is not transferable. Return and exchange procedures are governed by our Refund Policy.
8. Reviews, photos, and other submissions
You may submit product reviews, ratings, photos, videos, questions, comments, and other content (“Submissions”). By making a Submission, you grant Fast-Trac a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display it in any media, and to use the name you submitted with it, in connection with our products and marketing.
You represent that: the Submission is your own original work or you have the rights to grant this license; it is accurate and reflects your genuine experience; you were not paid or otherwise compensated for it in a way you have not disclosed; and it does not infringe anyone's rights or contain unlawful, defamatory, obscene, or abusive material, or anyone's personal information.
We do not undertake to monitor Submissions, and we may edit, remove, or decline to publish any Submission at our discretion. We do not adopt or endorse Submissions, and they do not represent our views. If you want a review you wrote removed, email us.
9. Communications and marketing
By providing your email address, you consent to receive transactional messages about your orders. If you opt in to marketing, you consent to receive promotional email, and you may unsubscribe at any time using the link in any marketing email. We do not send marketing text messages. See our Privacy Policy for how we handle your information.
10. Intellectual property and acceptable use
The Site and its content — including text, product descriptions, photographs, graphics, logos, the Fast-Trac name and marks, page designs, and compilations of data — are owned by Fast-Trac or our licensors and are protected by intellectual property law. We grant you a limited, revocable, non-transferable license to access and use the Site for your own personal, non-commercial purposes.
You may not, without our written permission: reproduce, duplicate, copy, sell, or exploit any part of the Site; scrape, crawl, harvest, or use automated means to extract data or pricing from the Site; use the Site's content to train a machine-learning model; frame or mirror the Site; reverse engineer or attempt to circumvent any security feature; upload viruses or malicious code; interfere with the operation of the Site; attempt to gain unauthorized access to any account or system; harass or abuse others; submit false information; or use the Site for any unlawful or unauthorized purpose. We may terminate your access for violating this section.
11. Third-party tools, links, and services
The Site provides access to third-party tools and services — including payment and financing providers, live chat, reviews, shipping and tracking, analytics and optimization technologies, and advertising partners — that we neither control nor monitor. We provide them “as is” and “as available” without any warranty, and your use of them is at your own risk and subject to the third party's own terms and privacy practices. Our Privacy Policy identifies the providers we work with and what information they receive.
Third-party links on the Site may direct you away from us. We are not responsible for the content, accuracy, or practices of third-party sites, and their inclusion does not imply endorsement. Any claim relating to a third-party product, service, or site is between you and that third party.
12. Disclaimers and limitation of liability
Except for any express written warranty we provide with a product, the Site and all products and services are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, timely, or error-free, or that any result obtained from using it will be accurate or reliable.
To the fullest extent permitted by law, Fast-Trac and its officers, directors, employees, agents, suppliers, and service providers will not be liable for any indirect, incidental, punitive, special, or consequential damages — including lost profits, lost revenue, lost data, personal injury, or property damage — arising out of your use of the Site or any product, whether based in contract, tort, strict liability, or otherwise, and whether or not we were advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to these Terms, the Site, or any product will not exceed the amount you paid to Fast-Trac for the product giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or of liability for consequential or incidental damages. In those jurisdictions our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes liability for fraud, or for death or personal injury caused by our negligence, where such exclusion is not permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Fast-Trac Industries Inc. and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your breach of these Terms, your violation of any law or the rights of a third party, your Submissions, or your installation or use of our products.
14. Termination
These Terms remain in effect until terminated by you or by us. You may terminate them by ceasing to use the Site. We may terminate them and deny you access to the Site at any time, without notice, if we believe you have failed to comply with any provision. You remain liable for all amounts due through the date of termination. Sections 8, 10, 12, 13, 15, and 16 survive termination.
15. Governing law and dispute resolution
These Terms and any dispute arising out of them or your use of the Site are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution first. Before filing any claim, you agree to contact us at info@fasttractraction.com and give us 30 days to resolve the dispute informally. Most issues can be settled this way.
Venue. If we cannot resolve the dispute informally, you and Fast-Trac agree that any action must be brought exclusively in the state or federal courts located in Lake County, Illinois, and you consent to the personal jurisdiction of those courts. This does not prevent either party from seeking relief in small claims court, or from seeking injunctive relief to protect intellectual property rights in any court of competent jurisdiction.
Time limit. Any claim arising out of these Terms or your purchase must be brought within one (1) year after the claim arose, to the extent permitted by law.
16. General
Severability. If any provision of these Terms is held unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted and severed to the extent it is not, without affecting the validity of the remaining provisions.
Entire agreement. These Terms, together with the policies incorporated by reference, are the entire agreement between you and Fast-Trac regarding the Site, superseding any prior agreements or communications, including prior versions of these Terms. Ambiguities will not be construed against the drafting party.
No waiver. Our failure to exercise or enforce any right or provision is not a waiver of it.
Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, labor disputes, supplier or carrier failures, and interruptions of utilities or telecommunications.
Changes to these Terms. You can review the current version of these Terms at any time on this page. We may update, change, or replace any part of them by posting the update here and revising the “Last updated” date. It is your responsibility to check periodically. Your continued use of the Site after changes are posted constitutes acceptance of those changes; changes do not apply retroactively to orders already placed.
Accessibility. We are working to keep the Site accessible to all riders. If you have difficulty using any part of it, contact us and we will help you complete your order and work to fix the issue.
